Victory Spirits Barrel Lab™ — Text Message Programs

1. Overview
These SMS Terms & Conditions (“SMS Terms”) govern your participation in the text message (“SMS/MMS”) programs offered by CWI Ventures LLC d/b/a Victory Spirits Development (“Victory Spirits,” “we,” “us,” or “our”) through the Victory Spirits Barrel Lab™ platform. By providing your mobile number and opting in, and by replying YES to our confirmation message, you agree to these SMS Terms and to receive recurring automated text messages from us. If you do not agree, do not opt in and do not confirm.
These SMS Terms supplement, and are in addition to, our Privacy Policy and any other agreement between you and Victory Spirits.
2. The Programs
Victory Spirits offers two separate, independently optional text message programs. You may subscribe to either, both, or neither. Subscribing to one does not subscribe you to the other.
Weekly Update. A weekly summary of new and changed barrel listings and other notable marketplace activity on the Barrel Lab™ platform. Typical frequency: up to one (1) message per week, sent only on weeks when there is qualifying new or changed inventory.
Real-Time Advisory. Time-sensitive alerts sent when a notable lot is listed or a significant marketplace event occurs. Frequency varies with marketplace activity, up to a maximum of one (1) message per day.
Message frequency for both programs varies. We do not guarantee a minimum or maximum number of messages.
3. Eligibility
The Barrel Lab™ and these text message programs are intended solely for licensed trade buyers in the alcohol beverage industry, including Distilled Spirits Plants (DSPs), Non-Distiller Producers (NDPs), importers, wholesalers, and brand owners. By opting in, you represent and warrant that:
- You are at least 21 years of age;
- You are acting on behalf of a licensed business in the alcohol beverage trade, or are otherwise legally permitted to receive communications regarding the wholesale purchase of distilled spirits; and
- You are the subscriber or customary user of the mobile number you provide, and you are authorized to opt that number in.
We reserve the right to verify eligibility and to decline or terminate participation at our discretion.
4. Cost
Message and data rates may apply. Victory Spirits does not charge a fee for the text message programs themselves, but your mobile carrier may charge you for messages sent to or received from us according to your wireless plan. Please contact your wireless carrier for details about your plan and any applicable charges.
5. Consent
By opting in, you consent to receive recurring automated marketing and informational text messages from Victory Spirits at the mobile number you provide, sent using an automated system. Consent is not a condition of any purchase. You may opt out at any time as described below.
6. How to Opt Out
You may cancel any text message program at any time by replying STOP to any message you receive from that program. After you send STOP, we will send you a single confirmation message acknowledging your opt-out, and you will no longer receive messages from that program unless you opt back in. If you are subscribed to both programs and wish to leave only one, reply STOP to a message from the program you wish to leave, or contact us using the details below.
7. Help
For help, reply HELP to any message, or contact us at purchasing@victoryspirits.com. Replying HELP will return basic information about the program and how to opt out.
8. Changing Your Mobile Number
If you change or deactivate the mobile number you provided, you agree to notify us promptly and to update your preferences so that messages are not inadvertently sent to a number that is no longer yours.
9. Delivery; No Guarantee
Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed. Messages may be delayed or may not be delivered for reasons outside our control. Carriers are not liable for delayed or undelivered messages. Victory Spirits is not responsible for any delays, failures, or errors in the transmission or delivery of any message, or for any action you take or fail to take in reliance on a message.
10. Supported Carriers
The programs are available on major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, and others. Carrier participation may change without notice. T-Mobile and other carriers are not liable for delayed or undelivered messages.
11. Privacy
Your privacy matters to us. Information you provide in connection with the text message programs — including your mobile number and the consent records we maintain — is handled in accordance with our Privacy Policy. We do not sell mobile opt-in information, and your consent to receive text messages will not be shared with third parties for their own marketing purposes.
12. Changes to These SMS Terms
We may modify these SMS Terms at any time. Changes are effective when posted to this page with an updated effective date. Your continued participation in a text message program after changes are posted constitutes your acceptance of the revised SMS Terms.
